People often wonder if they need Incapacity Planning, Estate Planning, or both. The simple answer is yes. Incapacity and Estate Planning aren't just about paperwork — they're about protecting your family, honoring your choices, and securing your peace of mind before the unexpected happens. Incapacity Planning and Estate Planning aren't just for the elderly, the ill, or the wealthy. It's for people who want to protect their family, secure assets, avoid Court, and be in control. Legal services just got easier.

Estate Planning FAQs

Do you really come to my home?

Yes. Rosswurm Legal, LLC is a traveling Estate Planning practice — Tracey comes to you, in the comfort of your own home. Pick a date and time online, and the consultation, planning, and signing all happen at your kitchen table.

What areas do you serve?

Tracey meets clients in person throughout Fort Wayne, Allen County, and across Indiana — including Indianapolis and Elkhart. If you're more than about two hours away, she works with you by phone.

How much does Estate Planning cost?

Rosswurm Legal, LLC works on flat fees — no hourly billing, no hidden fees. You'll know the cost up front before you begin.

What's the difference between a Will and a Living Trust?

A Will names who receives your assets and who handles your estate, but it goes through probate — a court-supervised process. A Revocable Living Trust lets assets pass directly to your beneficiaries outside of probate, and it also provides for management of your affairs if you become incapacitated. Many Estate Plans use both.

Does Indiana have an estate or inheritance tax?

No. Indiana's inheritance tax was repealed in 2013, and Indiana does not impose a state estate tax. That doesn't mean planning is unnecessary — probate, incapacity, and asset protection are still real concerns.

When should I update my will or trust?

Common reasons include marriage, divorce, the birth or adoption of a child, the death of a beneficiary or named guardian, moving to a new state, buying or selling significant assets, or changes in the law. A quick review every few years is a good habit.
